Preliminary note

This legal notice governs the use of the MARIFALA SAU website available at www.marifala.com (hereinafter "the Site"). By accessing the Site, every user acknowledges having read this legal notice and accepts it without reservation. This notice is drawn up in accordance with the law of the Republic of Guinea, in particular law L/2013/058/CNT of 7 November 2013 on intellectual property and the texts applicable to electronic commerce.

The Site relies on a distributed architecture split between two distinct technical providers: the storefront and the management application (back-office, database, media) are hosted separately.

Application & data host (back-office, database, media) — Laravel Cloud

ℹ Note: The host details must be completed as soon as the Site goes live. The publication manager is required to keep this information up to date in accordance with the Guinean legal obligations applicable to website publishers.

03 — Protection of personal data

3.1 Data controller

3.2 Data collected

In the course of using the Site, MARIFALA SAU may collect the following data:

• Identification data: surname, first name, company name;

• Contact data: email address, phone number, postal address;

• Data submitted via the contact or online order forms.

3.3 Purposes of processing

Personal data is collected for the following purposes:

However, MARIFALA SAU cannot guarantee the absolute accuracy of this information, which may be modified at any time without notice. The user uses the Site under their sole responsibility.

4.2 Availability of the Site

MARIFALA SAU undertakes to use its best efforts to ensure the continuity and quality of access to the Site. However, MARIFALA SAU cannot be held liable for any service interruptions due to technical failures, necessary maintenance, cyberattacks, or any other event beyond its control.

4.3 Excluded damages

Under no circumstances may MARIFALA SAU be held liable for any direct or indirect, material or immaterial damages resulting from access to or use of the Site, from the inability to access it, or from the use of information obtained from the Site.

Any hyperlink pointing to the Site from a third-party site must be subject to the prior written authorisation of MARIFALA SAU. Deep links (pointing directly to an internal page) are expressly prohibited without prior agreement.

MARIFALA SAU implements appropriate technical and organisational measures to ensure the security of the data processed via the Site and to protect the integrity of the Site against any attempt at intrusion, alteration, or unauthorised access. Nevertheless, no security system is infallible. In the event of a security breach likely to affect user data, MARIFALA SAU undertakes to inform the users concerned as soon as possible.

This legal notice is governed by the law of the Republic of Guinea, in particular:

• The provisions applicable to electronic commerce in the Republic of Guinea;

• The regulations in force on the protection of personal data.

Any dispute relating to the interpretation or performance of this legal notice that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts of Conakry, Republic of Guinea.

MARIFALA SAU reserves the right to modify this legal notice at any time, in particular to adapt it to legislative, regulatory, or technical developments. Changes take effect as soon as they are published on the Site.
